Recientemente me han llegado un par de casos de personas que se representan a sí mismas en el tribunal de inmigración. Son historias muy tristes. Estas personas nunca presentaron un cambio de dirección ante el tribunal de inmigración. El tribunal de inmigración emitió notificaciones de audiencias y, cuando el demandado no se presentó, el tribunal de inmigración fue rápido en emitir notificaciones de expulsión en ausencia. Esto significa que se ordenó deportar al extranjero porque no asistió a la audiencia.

¡No dejes que esto te pase a ti!

Muchos extranjeros piensan que simplemente al informar a ICE o al dar su nueva dirección a ICE, han cumplido con un cambio de dirección. Del mismo modo, muchos extranjeros piensan que simplemente al presentar un cambio de dirección ante el USCIS, han cumplido con el requisito judicial y han cambiado su dirección ante el tribunal de inmigración.

¡No te confundas! El gobierno de Estados Unidos ha jugado esta mala jugada a los alienígenas durante décadas, y sigue haciéndola. Presentar la declaración en una agencia no cambia automáticamente tu dirección con otra, ni siquiera dentro de la misma rama del gobierno. Por ejemplo, el hecho de que presentes un cambio de dirección en ICE no significa que tu cambio de dirección se actualice con USCIS. El hecho de que cambies tu dirección actual en ICE no significa que tu dirección sea transferida al tribunal de inmigración.

La razón: supuestamente tú, el extranjero, tienes que presentar el cambio de dirección tú mismo en tantos lugares como sea necesario. La carga recae en ti.

Así que no te confundas con tu aviso de expulsión en ausencia. Lo recibiste porque nunca presentaste tu aviso de cambio de dirección ante el tribunal de inmigración. Eso es algo muy importante y también muy sencillo: solo tienes que presentar el formulario EOIR-33C ante el tribunal de inmigración y enviar una copia a ICE. Por favor, guarda también una copia para ti y adjunta una copia para que el juzgado la marque con fecha y te la devuelva, junto con un sobre con tu dirección y sello con tu nombre y dirección correcta en el frente.

Si no lo haces, el tribunal de inmigración puede y emitirá notificaciones repetidas de audiencias a tu dirección registrada, y si esa dirección es incorrecta o es antigua, el tribunal te programará una audiencia a la que nunca comparecerás. Si no te presentas a esta audiencia, se te ordenará la deportación en tu ausencia, y entonces tendrás aún más problemas. La Junta de Apelaciones (BIA) dejo esto muy claro en Matter of DIJI, 30 I&N Dec. 1 (2026).  Así que, por favor, toma este consejo y comparte con tus amigos: presenta tu cambio de dirección a todas las agencias gubernamentales de EE. UU. según sea necesario. Simplemente presentar un cambio de dirección en una agencia no es suficiente.
